Terms
These terms apply when you use the Clear Duty website, take the free check, or buy the Psychosocial Risk Pack for NSW. The seller is Clear Duty, a business name registered to Richard Farmilo, ABN 80 650 936 256. Contact: hello@clearduty.com.au. In these terms, "we" and "us" mean Clear Duty, and "you" means the person or business using the site or buying the pack.
Your rights under the Australian Consumer Law
You have rights under the Australian Consumer Law that cannot be excluded. Where the law allows us to limit our liability, we do so only as set out under Limits on our liability. If there is a problem with the pack, contact us. Where the Australian Consumer Law gives you a remedy, such as a replacement or a refund, we will provide it.
Limits on our liability
- We supply the pack to businesses, for business use.
- To the extent section 64A of the Australian Consumer Law allows, our liability for a failure to comply with a consumer guarantee is limited to supplying the pack again, or paying the cost of having it supplied again. If the pack is treated as goods, the limit is replacing the pack, or paying the cost of replacing it.
- This limit does not apply to the consumer guarantees about title, undisturbed possession and undisclosed securities in sections 51 to 53 of the Australian Consumer Law.
- To the extent the law allows, we are not liable for any indirect or consequential loss.
- Nothing in these terms excludes any right that cannot be excluded by law.
- Nothing in these terms limits our liability for our own fraud, or any liability that cannot lawfully be limited.
- The pack is a management tool, not legal advice. You are responsible for how you apply it in your workplace.
Our refund policy
Separately from the limit above, and as our own policy: if the pack is faulty, does not download, or is not as described, we will refund the price you paid if you ask. This policy is in addition to your rights under the Australian Consumer Law and does not limit them.
The free check
The check is free. It scores your answers by fixed rules and gives general information about where your business stands. It is based only on your answers and is not legal advice.
Buying the pack
- The price is shown on the pack page and at checkout, in Australian dollars.
- Stripe takes the payment when you check out.
- After payment, we email you a link to download the pack. The link expires after a set time. If it expires before you have downloaded the pack, contact us and we will send a new one.
- The pack is written for NSW. Check that most of your workers work in NSW before you buy.
Using the pack
You may use, copy and change the documents for your own business. You may not sell them, publish them, or give them to another business, except where the law allows.
General information, not legal advice
The website, the check and the pack give general information and management tools. They do not take account of your circumstances and are not legal advice. Your business stays responsible for its own work health and safety duties. See our disclaimer.
Changes to the law
Each pack document shows the date it is current to. The law and the NSW Code of Practice can change after that date.
Changes to these terms
We may update these terms. The version in place when you bought the pack applies to that purchase.
Governing law
These terms are governed by the law of New South Wales.
